Terms of Service

1. Scope

These Terms of Service govern the use of Drenio. By creating an account, you agree to these terms.

2. Description of Service

Drenio is a platform that connects local farmers directly with customers. The platform enables:

  • Farmers can list plants and manage adoptions
  • Customers can adopt (reserve) plants and receive harvest updates
  • Deliverers can offer transport services for harvested produce

3. Registration

  • You must be at least 18 years old to create an account
  • You must provide accurate and complete information
  • You are responsible for keeping your login credentials secure
  • One account per person — duplicate accounts may be suspended

4. Plant Adoption & Orders

When you adopt a plant, you enter into an agreement with the farmer:

  • A reservation is not binding until the farmer confirms it
  • Once confirmed, the farmer commits to growing and delivering the harvest
  • Farmers may decline reservations at their discretion
  • Customers may cancel pending (unconfirmed) reservations

5. Prices & Payment

Prices are set by the farmer and shown per kilogram in the displayed currency. Drenio does not process payments and does not currently charge any fee for use of the platform. Payment is arranged and settled directly between the customer and the farmer, outside the platform, by whatever means they agree (for example cash on pickup or delivery, or a direct bank transfer). Drenio does not collect, hold, or receive any money and is not a party to the payment. Drenio is not responsible for disputes between buyers and sellers.

6. User Content

You are responsible for content you upload (photos, text, messages):

  • You must have the right to share any content you upload
  • Content must be lawful and not violate the rights of others
  • Drenio reserves the right to remove inappropriate content

7. Images and Photos

By uploading images to Drenio (profile photos, farm gallery, plant updates, etc.), you agree to the following:

  • You grant Drenio a non-exclusive, royalty-free right to display your images on the platform for the purpose of operating the service
  • You confirm that you own the rights to the images you upload or have obtained the necessary consent from depicted persons
  • You may not upload images of other people without their explicit consent (right to one's own image)
  • When you delete your account, all your uploaded images will be removed from the platform

8. Right of Withdrawal

Consumers have a 14-day right of withdrawal for distance contracts under Articles 27–30 of the Serbian Law on Consumer Protection (Zakon o zaštiti potrošača). However, this right does NOT apply to: (a) goods which are liable to deteriorate or expire rapidly — including all fresh agricultural produce, harvested fruit and vegetables, dairy and eggs; (b) sealed goods unsealed after delivery for hygiene reasons; (c) goods made to the consumer's specifications or clearly personalised. These exemptions follow Art. 37 of the Law. Almost everything sold via Drenio falls under exemption (a). For non-perishable items where the exemption does not apply, you may withdraw within 14 days of receipt by sending an email to info@drenio.rs. Cancellation of pending or confirmed reservations before harvest is always possible via the app and is governed by Section 4.

9. Food Safety and Allergens

Drenio is a marketplace, not a food retailer. The selling farmer is responsible for compliance with all applicable food safety, hygiene, labelling, and allergen regulations under the Serbian Law on Food Safety (Zakon o bezbednosti hrane) and any related rulebooks. If you have allergies or other dietary restrictions, contact the farmer directly via the in-app chat BEFORE confirming the reservation. Drenio does not verify allergen information and accepts no liability for the consequences of consuming purchased produce.

10. Liability & Disclaimer

Drenio acts exclusively as a technology platform connecting farmers and customers. We are not a party to transactions between users and assume no liability for the quality, safety, or legality of products traded through the platform. In particular:

  • We do not guarantee the quality, freshness, quantity, or condition of products offered by farmers.
  • We are not responsible for delays, damages, or losses during delivery — whether by the farmer, a third-party deliverer, or postal services.
  • We do not provide health, nutrition, or allergy advice. Users with allergies or dietary restrictions must clarify directly with the farmer before purchasing.
  • We do not guarantee the availability of any product. Harvest times, quantities, and prices may vary due to weather, pests, or other factors beyond our control.
  • Disputes between users (e.g. regarding product quality or delivery) must be resolved directly between the parties involved. Drenio may assist in mediation but is not obligated to do so.
  • We are not liable for indirect, consequential, incidental, or special damages — including but not limited to lost profits, lost revenue, lost business opportunities, lost goodwill, reputational harm, or losses arising from chain reactions of a failed transaction.
  • To the maximum extent permitted by mandatory consumer-protection law, Drenio's total aggregate liability for any claim arising out of or in connection with the platform is limited to the platform fees you paid to Drenio in the twelve (12) months preceding the event giving rise to the claim, or the equivalent of one hundred euros (EUR 100) in the applicable currency, whichever is higher.

Nothing in these terms excludes or limits Drenio's liability for death or personal injury caused by its negligence, for intent or gross negligence, or for any other liability that cannot lawfully be excluded or limited under mandatory applicable law. The liability cap above does not apply to any such liability.

Farmers are solely responsible for compliance with applicable food safety regulations, labeling requirements, and hygiene standards under the Serbian Law on Food Safety (Zakon o bezbednosti hrane) and any related rulebooks.

11. Seller and Deliverer Obligations

Farmers and deliverers using Drenio do so as independent persons or entities. Drenio is not their employer or principal and does not withhold or remit taxes, social contributions, or insurance on their behalf. By using the platform in either role you confirm that:

  • You hold any registration, permit, or status required by local law to offer your goods or services for sale (e.g. registered agricultural household, sole proprietor, or company), and will update Drenio if this status changes.
  • You are solely responsible for declaring and paying all income tax, value-added tax (VAT/PDV), social contributions, and other levies arising from sales or services concluded via Drenio, and for keeping any records your tax authority requires.
  • There is no employment, agency, partnership, or joint-venture relationship between you and Drenio. Drenio provides only the technical infrastructure that enables transactions; the underlying contracts are concluded directly between you and the other user.
  • Deliverers must additionally hold a valid driving licence, vehicle registration, and any insurance (third-party liability and, where applicable, commercial transport coverage) required for the deliveries they accept.
  • You agree to indemnify and hold Drenio harmless from any claim, fine, audit, or back-payment raised by tax, social-security, food-safety, traffic, or other authorities and arising from your failure to meet the obligations in this section.

12. Platform Service, Availability, and Payments

Drenio provides the platform on an "AS IS" and "AS AVAILABLE" basis. By using it you accept the following:

  • The platform is provided without warranties of any kind, express or implied — including but not limited to warranties of merchantability, fitness for a particular purpose, accuracy of listings, or non-infringement — except where such warranties are mandatory under applicable consumer-protection law.
  • We do not guarantee uninterrupted, error-free, secure, or timely operation. Scheduled maintenance, outages, bugs, third-party service failures (hosting, push notifications, email, image storage), and force majeure events may cause downtime or data unavailability without notice or compensation.
  • We may modify, suspend, restrict access to, or permanently discontinue any feature, listing, account, or the entire platform at any time, at our sole discretion, without notice and without liability to you or any user.
  • While we make reasonable efforts to back up data, we do not warrant data integrity, completeness, or recoverability. You are responsible for keeping your own copies of information important to you (orders, messages, harvest records, invoices). We accept no liability for data loss arising from system failure, hacking, user error, account termination, or platform discontinuation.
  • Drenio does not process, collect, or hold payments. It is not a bank, not a payment institution, not a payment processor, and not the merchant of record for sales between users. Any payment for products or delivery is arranged and settled directly between the users involved, outside the platform; the related risks (e.g. non-payment, cash handling, or a bank transfer that fails or is reversed) lie with those users and are not Drenio's responsibility. Should Drenio introduce a payment feature in future, that feature's separate terms will apply.
  • We are not liable for any failure or delay caused by events beyond our reasonable control, including natural disasters, war, civil unrest, government action, cybersecurity incidents, internet or telecommunications failures, or actions or omissions of third-party service providers.

13. Reporting Illegal Content (Notice & Takedown)

Every listing, user profile, and chat carries a report function. If you encounter content that is illegal, dangerous, fraudulent, or abusive, please report it through the in-app report button or by writing to info@drenio.rs. Drenio reviews reports and removes unlawful content or restricts the responsible account where warranted. As an information-society service provider under the Serbian Law on Electronic Commerce (ZET), Drenio is not obliged to monitor content proactively, but acts expeditiously once it obtains knowledge of unlawful content through such a report.

14. Account Termination

You may delete your account at any time via Settings. Drenio may suspend or terminate accounts that violate these terms.

15. Dispute Resolution

Disputes between users should first be addressed through the in-app dispute system. Consumer complaints can also be submitted to the Ministry of Trade, Tourism and Telecommunications of the Republic of Serbia or to a registered consumer protection association under the Law on Consumer Protection (Zakon o zaštiti potrošača). Drenio is not obligated to participate in out-of-court dispute resolution proceedings before any specific arbitration body.

16. Changes to Terms

We may update these terms from time to time. Continued use of the platform after changes constitutes acceptance.

17. Applicable Law

These terms are governed by the laws of the Republic of Serbia. The place of jurisdiction is Beograd, subject to mandatory rules on consumer jurisdiction under the Law on Consumer Protection.
